EQUIPMENT RENTAL AGREEMENT

Hire Agreement 2022-2023

This Equipment Rental Agreement (“Agreement”) is effective as of the date of last signature (“Effective Date”), and is made between Lovely Bubbly Spas, an events business organised under the laws of United Kingdom, Located in Warlingham, Surrey (“Lovely Bubbly Spas” otherwise referred to as "us", "our" or "we") and the renter (“Renter”, otherwise referred to as "you", "your" or "you're"). Owner and Renter are hereinafter collectively referred to as “Parties”.  Equipment refers to any property including, but not limited to hot tubs, parts and accessories, provided by Owner to Renter for a charge, a hire cost or for free.

Owner rents to Renter, and Renter rents from Owner, subject to the terms and conditions of this Agreement:

​

  1. Term.  This Agreement shall commence on the effective date and remain in full force and effect until the equipment is returned to Lovely Bubbly Spas.  You shall return the equipment on the date arranged unless terminated earlier consistent with the terms herein.

  2. Payment. The renter shall pay a non refundable deposit of £30 within 14 days of the order being placed or 14 days prior to delivery - whichever date comes first.  In the scenario that a booking falls within 14 days prior to delivery, then payment should be made within 2 days of being invoiced.  You shall pay the full balance to us before hire commences and authorise payment to Lovely Bubbly Spas to an amount equal to all payments and fees due under this agreement.

You can book using "cash" and no payment will be required on booking. We will contact you to check availability and agree terms.  We will then arrange the deposit payment with you either by cash or bank transfer.  Once the deposit payment is made, the date will be reserved for you.

If you choose to pay by "debit / credit card", then the entire balance will need to be paid.  You will need to check with us that we have availability for the dates that you require before making payment, as any refund would exclude any charges incurred and/or the deposit payment.  You should check availability by submitting a contact form from the shortcut bar at the top of this site.  Alternatively you can send a message via WhatsApp to 07888866600 or email us at info@lovelybubblyspas.co.uk.

You shall also pay other charges due to us, in accordance with this agreement upon return of equipment. Please see below, this being to the fullest extent allowed by law, including:

a) Charges for optional services, if any;

b) applicable taxes;

c) loss of, or damage to the equipment, loss of use, diminished value of the equipment caused by damage to it, and costs to enforce such charges including administrative fees for processing the claim and legal expenses;

d) a £100.00 charge per day for the unauthorised late return of the equipment (unless prior agreement is made);

e) unless due to the fault of Lovely Bubbly Spas - all fines, penalties, court costs and other expenses relating to the equipment assessed against Lovely Bubbly Spas or the equipment during the rental term;

f) all expenses and any loss of revenue Lovely Bubbly Spas incurs due to your failure to return the equipment on time or at all, including costs in locating and recovering the equipment;

g) all costs incurred to collect unpaid monies due by you to us;

h) a £50 cleaning charge applicable if the spa has been collected and deemed unreasonably dirty. I.e. due to using the spa whilst wearing fake tan / suncream.

i) any costs for repair made not prior to the agreement of Lovely Bubbly Spas including, but not limited to labour, materials, parts and other items.

Prior to booking.

You will need to check with us that we have availability for the dates that you require, including the additional delivery and collection dates provided.  This can be done by submitting a contact form from the shortcut bar at the top of this site.  Alternatively you can send a message via WhatsApp to 07888866600 or email us at info@lovelybubblyspas.co.uk.  Please do not make a payment by card until you are happy that we have availability for you, as any refund will deduct any charges.

You can book using "Cash" and no payment will be required. We will separately arrange the deposit payment with you for £30 and once the deposit is paid, the date will be reserved for you.  If you choose to pay by card, then the entire balance will need to be paid.  In this case, the deposit of £30 still exists and any cancellation will be fully refunded minus the deposit and / or any other charges incurred.

Prior to delivery.

You are to ensure that all access routes to the set up location are clear on your property boundary. I.e. Remove any wheelie bins, etc. from alleyways or doorways.

You are to ensure the health and safety of our delivery staff during the delivery process by providing them with a clear, trip free access route.

​

You are to ensure that the area to be used for the equipment is clear of any animal waste before the delivery.

​

You are responsible for measuring the area to make sure that there is adequate space for the hire equipment.  In the event that there is not enough space to set up, 50% of the paid fee will be refunded by us to you.  The remainder will be kept to cover our costs.

 

You are to ensure that the means for payment is available prior to Lovely Bubbly Spas arrival for the set up.  Cash or Bank transfer are accepted.

We reserve the right to refuse delivery on arrival if any of these terms aren’t met, with 50% of the agreed fee to be charged. This is to cover staff wages, costs of transportation and loss of revenue.

​

We cannot be held responsible for any damage to your property during the delivery process if this was caused in part, or in whole due to obstructions or negligence caused by your action or inaction.

Any damages caused by your gross negligence will be billed by Lovely Bubbly Spas to you accordingly. For example, a punctured or ripped hot tub liner will be billed at the cost of the repair (if possible) or at the cost of a replacement hot tub (up to a cost of £600).  If a replacement is needed, a like for like cost will be used where possible, but in the event of the Hot Tub no longer being available, then a suitable equivalent will be used instead. 

 

Non return / theft of equipment by you will be billed by us to you, at the full cost of the replacement.  If you do not agree to pay, then any outstanding amounts may be pursued by Lovely Bubbly Spas through legal means with any additional costs and charges for administrative time to be added to the claim.

If we arrive to deliver your equipment at the agreed time and no one is available to receive delivery, then we will try to rearrange delivery subject to an extra labour charge and fuel costs if necessary.

 

Normally we will give you a morning or evening delivery slot allocated up to 5 days prior to the hire date. Where available, you can choose a preferred timeslot but the timings cannot be guaranteed.  Lovely Bubbly Spas cannot be held liable for delayed delivery times due to issues beyond our control.

Prior to collection.

​

You are responsible to ensure that the hot tub is emptied prior to the collection times.  Emptying the hot tub can take between 2 to 4 hours as a guideline. 

 

You can connect a hosepipe to the draining tap using standard connections to direct the water to a drain or any area that you wish.  Though do note that the hosepipe must be level or go downhill, or the hot tub may not drain. 

 

We can offer hire of a submersible pump at an additional charge of £20 which will significantly increase the speed of draining the hot tub, and is available on request.

Collection times will happen on a specified day between 8am and 9pm.  You will be informed of a time slot usually 2-3 days in advance of delivery.  You are responsible to ensure that you are available during the allocated timeslot.  Failure to be available for the collection time slot will result in additional charges as explained in paragraph (f) above.​

Conditions of use for the renter.

  1. The spa must NOT be used by anyone wearing fake tan under any circumstances. Additional charges may apply if this happens to cover cleaning costs.

  2. The spa must NOT be used by anyone wearing sun cream under any circumstances. Use of the spa is permitted once any sun cream has been rinsed off.  Additional charges may apply if this happens to cover cleaning costs.  Subject to availability, options are available to provide cover from the sun, inform us if you would like to explore these. 

  3. Renter should be mindful of items that may “bleed” such as toys or costumes that may be colour dyed and / or that may cause staining.  Additional charges may apply if this happens to cover cleaning / replacement costs.

  4. No glass should be used in or around the spa. We can provide unbreakable glass for a small hire fee if required (subject to availability).  This is available upon request.

  5. The spa must be positioned within 7m of a power socket.  This should be measured along the route that a cable will lie and not "as the crow flies".

  6. Extension leads are not permitted for use.  Use of extension leads are not safe as they carry a fire risk.

  7. If no outdoor socket is available, then please be aware that the renter will be unable to close windows / doors on the cable due to the thickness.  The hot tub should remain plugged in to a power source at all times, including overnight.  The distance of 7m will need to incorporate any travel that the cabling needs to make.  You are responsible to ensure that the 7m distance includes any distance that the cable would need to travel.

  8. You must have the ability to fill the spa using your own hosepipe.  Lovely bubbly Spas will set up the hot tub and provide instructions.  You will need to fill it up with water.  

  9. You are responsible for using the chemicals provided by Lovely Bubbly Spas to ensure that the spa remains safe and hygienic during your rental period. We will provide guidance where requested of our delivery drivers.

  10. You must rinse the filter after every use to ensure that the water cleanliness remains stable and safe.  Failure to do so, will result in the water cleanliness deteriorating.

  11. Lovely Bubbly Spas cannot be held responsible for any illness caused through use of the spas whilst not following the correct guidance.

  12. You understand that where cold water is used to fill the spa, that it will take some time to reach your desired temperature.  Lovely Bubbly Spas deliver 12-36 hours in advance of hire at no additional cost to provide additional time for your hot tub to heat up.  Lovely Bubbly Spas cannot be held liable for the failure of the hot tub to heat up at a quick enough time frame to your desire due to weather conditions. You should incorporate the time required prior to booking your hot tub.

  13. You must ensure that you and your guests stay adequately hydrated whilst using the spa on high temperature settings.

  14. You are responsible to ensure that children are supervised by a responsible adult whilst using the spa, with a temperature no higher than 35C. 

  15. You are responsible to ensure that children under 5 years old do not use the spa due to a risk of drowning, dehydration and their inability to regulate their body temperature.

  16. You are responsible to ensure that no pets and / or animals are allowed access, deliberate or otherwise to the hot tub under any circumstances.  The lid must remain on and secured using the supplied fastening clips when the hot tub is not in use.

  17. Where Lovely Bubbly Spas deems it unsafe to set up, we reserve the right to cancel or postpone without any notice period. This may include, but is not limited to acts of god such as high winds or lightning.  In these circumstances we will offer a new date to you.

  18. You are responsible to ensure that any user of the spa is aware of and agrees with all of the above conditions before usage.
